Law, Family and Property
Legal rules that apply on marital property have tremendous impact on couples’ lives. They influence the lives of married spouses, as well as on cohabitants. They apply during the marriage and at its dissolution. Their impact is apparent when the couple is subject to the default rules, as well as when the spouses agree to diverge from them. They relate to property, but also influence on the contours of spousal relations, on the division of labor within the family, on the power relations, etc.
During the course the students will deepen their knowledge and understanding of the rules that apply on marital property, and with the theoretical principles on which they are based. We will focus on questions regarding the definition of marital property; various kinds of marital property (real estate, career assets, investments and debts, and so on); possible regimes for regulating marital property; the impact of the contractual approach to marital property; and the power of default rules. The course will combine between doctrinal discussion and theoretical ones. Therefore, it is tailored both for students who are not familiar with the issue of marital property, and for those who are familiar with the rules but wish to deepen the theoretical understanding of them. The course will focus on Israeli law, but will also include examples from other legal systems.
