כיצד מתפתחת ההלכה? מה הם הכוחות הפועלים עליה? מה הם יחסי הגומלין בין ההלכה ובין החברה? בשיעור זה נסקור התפתחויות הלכתיות מתקופת הזוגות ועד שלהי תקופת האמוראים בהקשרן ההסטורי, החברתי והדתי, נבחן את התפתחות המוסדות המשפטיים, הכתיבה ההלכתית והמנגנונים המשמשים את חכמים לשינויים הלכתיים ולפסיקה, נעסוק ביחס בין חכמים וסביבתם, ובזיקות ההדדיות בין הלכה וחברה בעת העתיקה ונעמוד על החשיבות של מוסדות אלה להיסטוריה של עם ישראל. הנוכחות בשיעורי הקורס היא חובה. לא ניתן להיעדר יותר משלוש פעמים ללא אישור.

Halakha and Society during the Mishnaic and Ammoraic Periods
How does the Halakha develop? What are the forces activating it? What is the interaction between the halakhic system and its society? In this course we will survey halakhic developments from the Second Temple through the Ammoraic period in their historical, social and religious context; We will investigate the evolution of the legal institution, the halakhic writings and the mechanism the sages use for halakhic changes; we will study the relation between the sages and their surroundings and the mutual influence between halakha and society in late antiquity; and we will examine the importance of these institutions to Jewish history.
