Course description
Antidiscrimination Law – Dr Yofi Tirosh
Discrimination is a basic human behavior – we make distinctions all the time, and base our decisions on such distinctions. When should law intervene and forbid discrimination? How might we (and should we) cope with covert cognitive biases of social actors? What are the effects of discrimination on primary goods such as liberty, welfare, and equality?
The class examines the philosophical roots of the idea of antidiscrimination and the challenges in shaping effective antidiscrimination rules. We will examine various legal fields such as civil law, private law, criminal law and public law. We will understand the different nature of discrimination against various groups, such as discrimination on the basis of sex, sexuality, age, race, disability, and more.
