D:\Inetpub\shared\yedion\syllabus\14\2016\1411\1411716801_desc.txt סילבוס מקוצר *עבירות מין – ד"ר עמית פונדיק* קורס זה יעסוק בתחום עבירות המין ויתמקד בכמה שאלות עקרוניות שעולות לגביו. נדון בשאלות כגון: מדוע הסכמה חשובה כל כך (ולא רצון, למשל)? אלו דברים הופכים הסכמה ללא תקפה (כפייה לעומת מרמה)? איך יש להוכיח אי-הסכמה (ובפרט, האם מותר לחקור את המתלוננת על עברה המיני לצורך כך)? מהו היסוד הנפשי הנדרש בעבירות המין (ופרט, האם ניתן לאנוס ברשלנות)? האם מעשיו הקודמים של הנאשם צריכים להיות ראיה קבילה להוכחת אשמתו (למשל, במקרה של הרשעות קודמות בפדופיליה)? האם עבירות המין הן תחום נפרד (כמו בישראל), או שהן רק סוג מסוים של עבירות התקיפה (כמו בקנדה, שם אין כלל עבירה בשם "אונס")? במקביל לעיסוק בשאלות הללו, הקורס ינסה גם להקנות מיומנויות בסיסיות בכתיבה אקדמית, מתוך מטרה לסייע לסטודנטים בכתיבה אקדמית בעתיד. דגש יושם על ניהול המחקר, הגדרת שאלת המחקר והבנת ההבדלים בין כתיבה אקדמית לסוגים אחרים של כתיבה. ד.מ. – דיני עונשין. מרכיבי הציון: עבודה 100%. הפרוסמינר מזכה ב-3 ש"ס. Course description *Sex Offences – Dr. Amit Pundik* This course on sex offences deals with some of its fundamental questions. Among the questions discussed are: why consent is so important (rather than the will, for instance)? What renders consent invalid (coercion vs deception)? How lack of consent ought to be proven in court (in particular, should a complainant be examined on her previous sexual history)? What is the required mens rea in sexual offences (and in particular, can one rape negligently)? Should the accused’s past behaviour be admissible evidence to prove his guilt (for instance, previous convictions of paedophilia-related offences)? Are sexual offences a special kind of offence (as in Israel) or are they just a type of assault on the person (as in Canada, where no offence is named “rape”)? Parallel to discussing these questions, the course also seeks to equip students with basic skills of academic writing. A Particular emphasis is placed on managing the research, defining the research question, and understanding the differences between academic and other types of writing.

This course on sex offences deals with some of its fundamental questions. Among the questions discussed are: why consent is so important (rather than the will, for instance)?
