הקורס עוסק בהתפתחות החוקים הנוגעים לתשלום כופר נפש בהלכה המוסלמית ובאופן שבו ההתפתחות הזאת משקפת שינויים בדת, בחברה ובפוליטיקה באסלאם של ימי הביניים. זאת בהתבסס על קריאה בטקסטים היסטוריים והלכתיים (בערבית), ועל ספרות מחקרית. עד כמה שהזמן יאפשר יידונו סוגיות אלה גם בהשוואה למערכות חוק של חברות אחרות.
Course description
The course deals with the development of Muslim law of blood-money payment. It will concentrate on the way that religious, social and political circunstances influenced the nature of the law in this regard. A comparison to the attitude of other legal systems to this issue will be discussed as time allows. The course will be based on the reading of historical and legal Arabic texts, as well as of modern studies.
